For Immediate Release: CSPOA Calls Upon Pima County to Repeal Recent Firearm Ordinance

22 March 2024 – Constitutional Sheriffs and Peace Officers Association (CSPOA.org).
The Constitutional Sheriffs and Peace Officers Association calls upon the Pima County Board of Supervisors to immediately repeal their recent ordinance relating to reporting the loss or theft of a firearm. In the first place, the BOS (Board of Supervisors) has no authority to require specific performance of citizens in the county. In the second place, the ordinance is unconstitutionally vague.
It does not define “loss”, leaving a wide-open space in the conclusion that the weapon was lost, stolen, or simply temporarily misplaced, and it leaves open the situation where, after having been reported as lost, the firearm is somehow recovered by the owner.
The ordinance does not cover what actions the owner may take after recovery. Therefore there could arise a situation where there may be many firearms that have been reported as stolen or lost, and yet have been found by the owner, who's under no obligation to report the recovery, and therefore the list on file of supposedly lost or stolen firearms, would be widely inaccurate.
In summary, the ordinance is unnecessary, unconstitutionally vague and far exceeds the Board of Supervisors' authority.
