County Sheriff slams BLM and Understands Oregon Protestors

(By Rick Dalton 17 January 2016) In a forceful rebuke of federal criminal activity against the Hammond Family of Burns, Oregon, Milwauke County, Wisconsin Sheriff Davie A. Clarke Jr., in a podcdast a week ago, talked about civil disobedience being sometimes necessary to correct the path of abusive federal agencies. Clarke’s show, which can be found on Stitcher.com, was devoted entirely to the Oregon standoff between citizens and the BLM.  Armed protestors have peacefully taken over a vacant  federal building outside the town of Burns, in order to draw attention to the plight of the Hammonds. You can liten to the episode by clicking HERE. Sheriff Clarke was the Sheriff of the Year at CSPOA for 2013, and has been in demand on national news outlets to share his conservative, no-nonsense brand of law enforcement ideas, which include suggesting his constitutents purchase and train with firearms so they can defend themselves from attacks. The standoff in Oregon is in its second week, and the federal building where the armed protestors are squatting has been basically quiet, even though there are swat teams, military special operators, and FBI undercover agents posing as militia, all in the area.  The goal of the occupation of the wildlife refuge headquarters is to force the BLM to return the land to the people who need it to make a living.  Another goal is to secure the release of a ranching father and son who have been sent to prison for a second time for the same offenses for which they were originally convicted. Sheriff Clarke outlines the history of the dispute over rural land...

States are pushing back against federal anti-gun acts

(Posted by Rick Dalton 16 January 2016) In the wake of Obama’s outside-the-Constitution plans to gut the RTKBA, states are exercising the advice of some of the Founders and enacting nullification bills. This video, from the Tenth Amendment Center, outlines several of the state level barriers being erected against federl encroachment.  Watch it below. In other 2nd Amendment news, Arizona’s law allowing concealed carry without a permit went into effect last week....

Florida CSPOA honors Sheriff Wayne Ivey

(By Kevin Blake, Florida CSPOA Director, 13 January 2015) Another month has passed us by and we find ourselves in a New Year. From all of us at the Constitutional Sheriffs and Peace Officers Association we want to wish all Sheriffs, Peace Officers, Public Servants and Citizens a prosperous New Year. We must remember the monumental accomplishments of not only the CSPOA but others who have had a stake in defending freedom throughout our great Republic. One of the blessings we have here in the United States is the office of the Sheriff and we do recognize that not all sheriffs are created equal. But, more and more we find ourselves counting these blessings as more sheriffs stand to be counted. This should be a joyful moment for all of us as we witness these “Davids” stand up to Goliath, and through their actions, classify themselves as servants of the people and defenders of the Constitution. With that being said, we turn our attention to Brevard County Sheriff Wayne Ivey. In a video posted earlier this month to the agency’s Facebook page, Sheriff Ivey said “The only thing that stops a bad guy with a gun is a good guy with a gun.” Sheriff Ivey continues, “Like each of you, I’ve had enough of terrorists and others who decide they want to target U.S. citizens because they want to make a statement or get their 15 minutes of fame. Now, more than ever before, is the time for law enforcement and citizens to be fully prepared for an attack or an active shooter scenario with the right tools to...

Citizens Rally to Oregon to support the Hammond family

(Posted by Rick Dalton, 3 January 2015)  A ranching family in Burns, Oregon has suffered at the hands of federal bureaucrats for years, and on Saturday, January 2nd, hundreds of American citizens rallied in Burns in support of the family, and against the terrible treatment they have received by federal agents. The incident stems from an overzealous prosecution by federal agents because of a backfire set on their own property by the Hammonds, to stop a lightening-cause fire from destroying their cattle grazing land. The fire got out of control, and burned some “federal” land. The Hammonds were prosecuted as terrorists, and have received a cruel and unusual sentence.  CSPOA President, Sheriff Richard Mack (Ret.), was among four CSPOA leaders who were present at the peaceful rally.  It was a wonderful experience, according to all.  After the rally, some people took it upon themselves to drive out of town and take over an unoccupied federal building, without the knowledge or support of CSPOA.  Here is Sheriff Mack’s firsthand report of the events of yesterday. CSPOA Final Hammond Press Release Date: January 3, 2016 Submitted by: Sheriff Richard Mack On January 2, 2016, four of us representing the CSPOA attended the rally in Burns, OR on behalf of the Hammond family. It was an extremely frigid day and being outside was not fun or the least bit comfortable. But the cause we were there to support was worth enduring the inclement weather, so we persevered. We met at the Safeway parking lot and after a few instructions about where we would be heading, we all started the march. The crowd...

New budget continues funding for Planned Parenthood, as well as the program bringing immigrants from terrorist-supporting nations.

(By Rick Dalton, 19 December 2015) Despite the warnings from top national security Homeland Security advisors, a bill, just passed by the House and Senate this past week, and sent to Obama’s desk, would continue funding for our refugee resettltment program, which brings in immigrants from thirty nations that are known to sponsor or shelter terrorists.  It also increases spending and the national debt, and fully funds Planned Parenthood. With the ever-present danger of terrorist attacks in the US, like the one recently in San Bernadino,Califormia, ISIS and Al Quaeda have both announced that they will infiltrate the refugee flow from these nations with jihadis, who will kill innocent Americans. Many have called for a pause in immigration from this area of the world.  Ted Cruz offered an amendment to the bill to cut funding for the refugee program, but only 10 members of the senate voted for it, including Cruz and Rand Paul.  Marco Rubio voted against the amendment. Planned Parenthood is reeling from public exposure of its marketing of baby body parts for profit. To find out how your congressperson voted on the big bill, go HERE for the house vote, and for the senate vote,...

Florida CSPOA Announces Public Official of the Month for November

(by Kevin J. Blake, CSPOA FL State Director, 12 December 2015) Florida has great weather, and some great peace officers and public officials as well. The CSPOA of Florida is proud to introduce you to our Public Official of the Month for November. Walton County, FL, Sheriff Mike Adkinson borrowed an idea from Sheriff McKeithen over in Bay County. That idea is to put “In God We Trust” bumper stickers on all of the patrol cars. This decision was not about religion, the decision was about principles! All who know us know we are all about standing on principle,; the principals of freedom, the principals of the Constitution and the principals set forth in the law. “The community as a whole has just been tremendously engaged in reaching out” said Sheriff Adkinson. “But it’s our staff that has come forward and said, ‘sheriff this is what we’re about.’” Many of the citizens have been supportive also. Others, such as the Freedom From Religion Foundation, did not like the idea. They sent a letter to the sheriff expressing that the bumper stickers will hinder deputies from performing their jobs and will lead deputies to change the level of service they provide based on personal principals.  Sheriff Atkinson reminds us that “In God We Trust” is the Motto of the State of Florida and of the United States. Perhaps we need to remember the words of the Law Enforcement Code of Ethics, which reminds peace officers Who is watching over them, and what principles they must uphold. Here are some excerpts, straight from the P.O.S.T (Peace Officer Standards and Training) manual:...

Florida Sheriff puts controversial message on every patrol car.

(by Rick Dalton 5 December 2015) Walton County, Florida Sheriff Michael Adkinson Jr. is in the process of placing a bumper sticker on all the patrol vehicles of his agency. The messsage, is “In God We Trust”. Even though he has received some flak, and some talk of a lawsuit, he stands his ground, reminding citizens that this is the motto of the Stateof Florida, and the Motto of the nation.  Th Full news story can be found HERE Not everyone agrees. According to a letter sent to Adkinson by the Freedom From Religion Foundation, the bumper stickers could hinder a deputy’s ability to fulfill their duties and provide a different level of service based on personal principles. “I found that to be patently offensive,” said Adkinson. “Much more offensive than placing the state motto on our car.” Anyone who disagrees, says the Sheriff, has “two options. You can get a court order or, two, you can get a new sheriff,” said Adkinson. “But I assure you, it’s not something I’m prepared to compromise on. It’s not going away.” Marianna kicks off Christmas season with parade More From our Partners Hillary Clinton is taking on the NRA. Say you’re with Her. Wise leaders advise citizens to shoot back

(by Rick Dalton, 4 December 2015) In the wake of the Islamic terrorist attack in California this week, and despite Obama’s call to restrict the use of firearms in America, law enforcement leaders are calling on their citizens to arm and fight back, being ready to stop active shooters before the police arrive.  Sheriff David A. Clarke, Jr., of Milwaukee County WI, has been a longtime supporter of citizen self-protection. Sheriffs Joe Arpaio, of Maricopa County, Arizona, Paul J. Van Blarcum of Ulster County, New York, as well as the chief of police in Detroit, James Craig,  are encouraging citizens to exercise their right to defend themselves. There were cries of “how will the cops know the good guys from the bad guys?”, if there are armed  citizens on scene when police arrive. “This is the standard response of many police executives when testifying on legislative measures to allow guns on college campuses, and faculty possession on high school campuses, according to Rick Dalton, CSPOA legislative liaison.   Well, as we know from previous events, when armed citizens are on the scene from the start, the bad guys are often dead or fled before the cavalry gets there, and the good guys have holstered their weapons. If not, police and citizens will have to work out a protocol. “It’s not a reason to prohibit Americans from protecting themselves just because the police might not be able to tell the difference”, said Sam Bushman, CSPOA VP for Operations. It’s a whole lot more desirable than just having people lay down and...

CSPOA opposes ban on personal body armor

( By Rick Dalton, 29 November 2015) The latest efforts to attack personal defense as a natural birthright comes from distinguished Congressional representatives Alcee Hastings (D-FL), Robin Kelly (D-IL) and Danny Davis (D-IL) and takes aim not at your ability to possess a firearm, but rather, to protect yourself from criminals who own them. HR 378, dubbed the Responsible Body Armor Possession Act, would make it illegal for civilians to own “enhanced body armor” such as helmets, shields or armor plates that meet or exceed Type III protection. The bill would exempt law enforcement officers and other government officials. The new law would still allow Americans to own Type I and Type II protection, which are designed to stop calibers ranging from .22 caliber to .357 Magnum respectively. Type III body armor is designed to stop higher velocity hand gun rounds like a high-velocity 9mm or .44 magnum and rifle rounds like the AK-47′s 7.62x39mm. Type IV, often reserved for special law enforcement response teams, is capable of stopping even armor piercing rifle rounds. CSPOA is strongly opposed to this bill for the same reasons we defend the 2nd amendment. We urge all members and friends to call their representatives and tell them to oppose this bill. The text of the bill is at the link below....

Florida CSPOA announces Public Official of the Month

Kevin Blake, Florida Director for CSPOA, announced that Sheriff Gordon Smith of Bradford County, Florida, is the  Florida CSPOA Public Official of the month for October 2015. According to Kevin, The October 2015 Florida Public Official of the month is Sheriff Gordon Smith of Bradford County for his stance on the right to keep and bear arms. Congratulations sir and to all of the Florida Public Officials standing up, keep up the good work gentlemen. After speaking with Sheriff Smith, he has revealed himself as a staunch constitutionalist; Sheriff Smith not only performs his service to the people of Bradford County in a Constitutional manner but he holds the founding documents of this Nation as a core value in his everyday life in and out of uniform. Sheriff Smith also supports the mission of the CSPOA and is a strong advocate for the Second Amendment. Sheriff Smith, once again great job from all of us here at the CSPOA and keep up the great work. Here, in his own words, is Sheriff Smith’s strong defense of the right to self defense.   A detailedreport from Florida on CSPOA activities will be forthcoming in our monthly newsletter.  If you are not a subscriber, to to the national website and join, at...

News Items from this week.

(by Rick Dalton 10/30/2015)  Tucson PD officers make a traffic stop on a black CCW permit holder. Now, don’t jump to conclusions. The citizen even posted to FaceBook about how professional and courteous they were to him.  It turned out wonderfly. It’s too bad this incident is big news.  It should be mundane.  Here’s the news account of the incident.  Click HERE   School Resource Officer fired after removing an unruly student from a classroom. A Sheriff’s deputy who was called to remove a student who was disturbing a classroom and refusing to leave, had to use force to remove her.  Exactly the type of force used has cause a big debate. Two news stories cover the two sides of the story.  CSPOA has not taken a position on the matter because we do not have all the facts of the case.  For the basic story, click HERE. Florida Sheriff defends Constituents’ Right to Self Defense

(by Rick Dalton 10/27/2015)  It was a hearing last week  on “open carry” in Florida, and Sheriff Gordon Smith of Bradford County was clear and concise in his testimony. He supports open carry.  Florida State Director for CSPOA, Kevin Blake, said, We applaud Sheriff Smith’s courageous and legally strong position.  The people who he serves should be grateful for his leadership and willingness to take criticism for doing the right and the Constitutional thing.  He joins Sheriff Nick Finch of Liberty County and other good sheriffs, peace officers and elected officials in Florida in living up to their oaths. We’ll let Sheriff Smith make his own case in the following video....

Chief’s Association Fires a Shot at the 2nd Amendment

(by Rick Dalton) The International Association of Chiefs of Police (IACP), at its recent annual conference in, of all places, Chicago, called for universal background checks on all purchases and transfers of firearms, private or otherwise. According to a Reuters news story, “The proliferation of firearms is one of the factors behind a rise in homicide rates in many U.S. cities this year, according to senior law enforcement officials at the International Association of Chiefs of Police conference in Chicago. Acknowledging the power of the gun lobby and the reluctance of Congress to enact stricter gun laws, the police chiefs told a news conference they were not anti-gun but wanted to keep weapons out of the hands of people with criminal backgrounds. “Current rules on background checks apply to licensed dealers, but up to 40 percent of firearms sales involve private parties or gun shows and do not require checks, the chiefs said. According to CSPOA President Sheriff Richard Mack (Ret.) “Chicago has some of the strictest gun laws in the nation, and it’s also a great place to to to get murdered.  If crime laws actually worked, we’d be living in the Utopian Socialist , crime-free heaven on earth dreamed about by Chicago Mayor Rahm Imanuel.  More gun laws will only disarm more law abiding Americans and further embolden criminals. The recent increase in homicide rates in some US  citesis not related to a “proliferation of firearms” as the IACP statement claims, says CSPOA Executive VP and Legislative Liaison Rick Dalton. “Contrary to IACP’s claims, firearms possession has risen dramatically for the past 20 years or so in...

Sheriff’s gun views spark effort to revoke certification

(by Rick Dalton 10/17/2015)  The sheriff of Wicomico County Maryland, Mike Lewis, has been a staunch protector of the rights of those citizend who elected him.  He has taken a stand to preserve the RTKBA against any further infringement. “As long as I’m the sheriff in this county, I will not allow the federal government to come in here and strip my citizens of their right to bear arms. I can tell you this, if they attempt to do that, it would be an all-out civil war, no question about it.” It was the above statement is what seemed to send the anti-gun group Coalition to Stop Gun Violence into a hissy fit.  They claimed that Sheriff Lewis had threatened violence against the government, and have started a petition drive to demand the revocation of his teaching certification.  We pick up the story in the online edition of Delmarvanow.com : The campaign to revoke Lewis’ teaching certification began Monday, and as of about 4:15 p.m. Tuesday, about 1,470 signatures had been collected via an online petition, said Ladd Everitt, director of communications for the Coalition to Stop Gun Violence, a Washington-based gun control group. “When you employ violence against your government essentially to effect policy decisions, you are damaging the principle of political equality,” Everitt said CSPOA stands squarely behind Sheriff Lewis and will be contacting him to offer any assistance we might be able to give.  Executive VP and Legislative Liaison Rick Dalton said “There is such a thing as an unconstitutional law, and it is the sworn duty of peace officers and all elected officials to protect...

Sheriffs uphold their oaths, defend RTKBA

(by Rick Dalton 10/17/2015)   “I will not allow gun confiscation in my county.” An Indiana sheriff says he would ignore orders issued by President Obama calling for gun confiscation.  So said Sheriff Brad Rogers, of Elkhart County, Indiana .  The recent shootings in Orgeon and Arizona have sparked yet another campaign to limit ownership, register, and, according to many law enforcement professionals, confiscate firearms. For Sheriff Rogers, a member of our CSPOA Advisory Board, this is nothing new.  He is a staunch defender of the 2nd Amendment, and, indeed the entire Bill of Rights.  He prevended harrassment of an Amish farmer in his county by the federal  Department of Agriculture. and threatened to arrest any federal agents who might contact this farmer again without a due process search warrant. CSPOA Founder and President, Sheriff Richard Mack ((Ret.), knows that indeed, Obama can’t coerce any state, county or local governemtal agency into following an executive order, or even federal legislation.  “First of all, the President only has direct authority over the executive branch of the Fedgov. Not an iota more”, he said.  “In fact, I and a few other sheriffs challenged the Brady Bill twenty years ago.  We won a landmark Supreme Court Decision that said just that”.  [Mack Printz v. US]  Sheriff’s don’t work for the federal government.  Period.” Here is an account of his latest interpisition on behalf of his constitutents, as reported by the Conservative Read.     “Elkhart County Sheriff Brad Rogers made his stance on the Second Amendment clear during an interview on a local PBS broadcast, in which he supported the right of Americans...

Go Home! Message greets Obama in Roseburg Oregon.

(by Rick Dalton) Breaking as we write: Organized protests are in place to greet Obama as he visits (without invitation) the grieving community of Roseburg Oregon.  CSPOA has a presence there, as does Oathkeepers.   The problem, according to Sam Bushman, Vice President for Operations, is that “Obama is trotting out the failed and divisive ideas about eliminating access to firearms.”  “We have to change our culture and return to the fundamental principles of kindness, civic virtue, and love of God, all of which gave America strong traditional families, which are the building blocks of a strong nation”, he said. Obama has said he will issue new executive orders to tighten up background check requirements for purchasing a firearm.  Constitutional scholars counter that his authority only goes as far as the executive branch of the federal government.  The Constitution gives the president no power to dictate to state or local government officials to enforce or otherwise aid in a federal regulatory scheme. Some of the protesters will be armed, according to news reports.   Read more HERE....

Indictment of Former Chief Shane Harger Dismissed

Date: 09/24/2015 Posted by Sam Bushman On September 24th, 2015, District Court Judge Eichwald ruled that the indictment of former Police Chief Shane Harger was in violation of state law. The prosecution was found by the judge to have committed prosecutorial misconduct in that they violated the rules of the grand jury proceedings and that the state withheld exculpatory evidence that would have cleared the chief of any wrongdoing. The state’s witness provided false and misleading testimony to the grand jury in order to prejudice the jury; therefore the case was dismissed. Mr. Harger is currently represented by Ray Towig and State Representative Lisa Torraco, as well as the Rutherford Institute. Thursday, August 7th 2014, former Jemez Springs Police Chief, Shane Harger, was indicted and arrested on charges related to several allegations made by a 19-year-old female self admitted heroin addict named Dusty Keane. On his way to jail he was intentionally paraded before a well prepped media with news cameras rolling. Will that same media have the integrity to trumpet the truth and have news cameras roll once again in Harger’s defense? Not a Chance! The state prosecutor requested an increase in his bail from $150,000 to $500,000, claiming that he was a flight risk; Judge Eichwald raised his bail to $250,000 cash or surety. The fact that the alleged victim in this case did not testify before the grand jury panel or show up at the arraignment is quite telling about her own credibility. “Harger is innocent of these charges, and that will become abundantly clear as this case moves forward,” his attorney, said in a statement....

Peace in Unity with Officer Billy Ray Fields

(Posted by Rick Dalton) I had a great trip this past weekend to south Georgia for the Peace in Unity Rally. This is the brainchild of Officer Billy Ray Fields Jr., of Ocilla PD in Georgia. The event was held in Douglas, GA, and we had a great time. CSPOA is proud to support this positive movement in the US. Billy Ray’s idea was a way to bring the police and community together and stop the hatred and bad feelings between police and citizens. The activities included a basketball tournament and barbeque on Saturday, and a “Pack the Park” day on Sunday that featured a “dunk-a-cop” game, police and fire demonstrations, and great food. In addition, Sponge Bob and Mickey Mouse made an appearance!   It was also a pleasure to meet Billy’s parents. His father, Billy Ray Fields Sr., was a police officer, sheriff’s deputy and chief of police in a neighboring town. That’s a great background to come from, as both his parents served the state of Georgia in government positions. We salute Officer Fields and his...

Sheriff Clarke takes on “black lies matter” after Texas sheriff’s deputy is murdered.

Sheriff David A. Clarke Jr., CSPOA Sheriff of The Year for 2013, took the gloves off in his reaction to the murder of Harris County, Texas, Deputy Sheriff Darren Goforth.  On a recent Fox News program, Sheriff Clarke expressed his anger and frustration at the war on police that is growing in America. He laid at last partial blame for this escalating violence on the Black Lives Matter movement, which has become increasingly extreme in its call for killing police.  Clarke calls it the “black lies matter”, movement, because is it built on the falshehood of “hands up don’t shoot” describing the attack on police officer Darren Wilson by felon Michael Brown, which ended in Wilson killing Brown after a struggtle for the officer’s gun.  Additionally, he placed partial blame on the whitehouse and the Obama justice department for inflammatory rhetoric that fueled the fires of violence. CSPOA stands squarely on the side of the rule of law, and in sympathy with the thousands of peace officers who put their lives on the line, and increasingly, give their lives, to serve their communities.  At the same time, we decry those very few officers who use excessive force and fail to serve their communities.   And we urge everyone to take a step back and rethink their actions as well as their words.  Read more of this story in the account published in the New American Magazine...

Texas Deputy Sheriff Assassinated in Uniform and On Duty

Ten-year veteran Deputy Darren Goforth, of the Harris County, Texas, Sheriffs Office, was gunned down last week as he fueled his patrol car at a gas station. Shot in the back without warning, he died at the scene. Ballistic evidence ties the shooter, Shannon Miles, a black man, to the scene.  Deputy Goforth was white.  Miles’ mother, however, claims he was shopping with her at the time. Deputy Goforth leaves behind a wife and two children.  Read more from NBC News HERE This hate crime happens against a backdrop of ant-police violence and vitriol that seems to be spreading across America. Several peace officers in differnt parts of the nation have been intentionally ambushed and killed in recent months. At the same time, citizens in many cities have deomonstrated,  rioted and destroyed property in protest against perceived police excessive use of force.  In fairness, there have been instances where officers have indeed over-reacted and killed unarmed citizens in situations where it seem obvious deadly force was not necessary. There must be a coming together of law enforcement personnel with the communties they  serve.  We offer training to law enforcement agencies to help close the gap in some communities, and to fortify officers in their goals to protect and serve. CSPOA sends prayers and good will to Deputy Goforth’s family, friends and colleagues.  We also urge all peace officers to exercise extreme caution and remember their officer swafety training both on duty and off.  Wait for your back up, and be alert at all times.  Hesitation can be...
