Wait, what? Why does Tim have to be a hacker? Shouldn’t the government have access to all that data legally? Yeah, that’s what they want you to think. So many shows out there portray government & law enforcement as our infallible, benevolent protectors. They go where the evidence leads, they follow their gut and they never, NEVER get the wrong man. These shows do so much to make you trust your government. They want you to believe that law enforcement should have access to all information about everyone, all the time. But not you personally, of course. Only the bad people; only the ones they are trying to catch.

The truth is, by constitutional law personal information is strictly protected. The text of the Fourth Amendment reads, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

That’s a pretty succinct and clear statement. People knew how to write laws back then! Even though computers did not exist at the time, the right to be secure in your papers and effects clearly applies whether this information is stored physically or digitally. If law enforcement wants to look up someone’s phone records, they are required by law to get a written warrant based upon probable cause and supported by a sworn oath. Do you see what the intent of this law is? Like the rest of the Constitution, it’s all about protecting the freedom of the individual. When it comes to a choice between catching the bad guys and violating the freedoms of the individual, the Constitution is clear: Protect the freedom of the individual. There will always be more bad guys to catch; there will not always be more freedom once the government gains control.

Thus, personal information is carefully stored and segmented. Each state has it’s own DMV and other records, not to be shared lightly. Banks, phone companies, doctors and other businesses all have their private stores of information about us, all of it protected by the Fourth Amendment. They cannot legally give that away unless required to do so by a warrant. Yes, in law enforcement, warrants and proof can be real roadblocks to catching the bad guys. There are many times, perhaps even MOST times, when you know darn well who did it; you just don’t have the proof. But that’s OK; The regular, everyday people are not subject to the whims of the government, and we like it that way. If you think someone is guilty but you just can’t prove it, you’re in the same boat as someone who knows someone is not guilty but wants to cause them trouble. Since we can’t know everybody’s motives, we have a law in place. In either case, the answer is the same: Prove it. PROVE IT! If you can’t, then leave them alone.

Every time we see Timmy hacking in to someone’s account, we should be reeling in shock and saying “WAIT! HE JUST VIOLATED THE SUPREME LAW OF THE LAND!” But instead we sit back and think that it was all for a good cause and good guys like Timmy should have the access they need to get the job done. Because he’s a likable character, and he would never misuse that power. And all employees and those in public office are just like Timmy; harmless guys just trying to get the job done, and why don’t we just let them? What could it hurt?

And while we’re on the subject, let’s talk about guns in the media. When is the last time you saw a popular show where a civilian was able to defend himself against and attacker with his personal weapon? It doesn’t happen. Inevitably, the gun gets knocked away or turned on the individual. There are some thoughts that the networks just don’t want you to have. You cannot defend yourself. You are helpless and you need us, and we are here to protect you.

While the government is your employee, it is here to protect you. When the government is in control, the roles are reversed. Yet those seeking power love to tell us, “We could do a much better job of protecting you if we had more control over you.” Yes well, we’ll take our chances with freedom, thank you very much.

And what of required background checks and mental health evaluations? Well, constitutionally, you CAN’T do that without a warrant unless I give you permission. So if you think I’m guilty of a crime, then by all means, have a witness swear to it and get yourself a valid warrant. THEN you can search ONLY in the places specified by the warrant for evidence you need against me. Otherwise, I DO NOT give permission for you to search my home, car or records to find out about my guns. I DO NOT give permission for you to ask my doctor about my mental health.

However, since you are on my property I would like to ask that you hand over your guns, and please submit to a mental health evaluation that I’ve designed. Not willing? I ask you to leave. Because I am an American and that still means something to me.

Piers Morgan does not respect the views of others, nor does he even pretend to give others a chance to present their opinions in any semblance of fairness. Note how his seething rage drives this entire exchange. On the other hand, see how Sheriff Clarke calmly and confidently expresses his position and defends his own actions in the face of vicious attacks without appearing the least bit flustered. If only Piers Morgan had developed this kind of confidence and self control, perhaps he could have made something more of himself than the circus side-show act that he is. His resort to personal attacks are one of the clear evidences that he is flailing wildly in his attempt to drag Sheriff Clarke down to his extremely low level. Our advice to other sheriffs or public officials who might get a request for an interview with Piers Morgan: Don’t bother. It will only be a chance for Piers to spout his filth while your face is on the screen.

The following sheriffs, state sheriff’s associations, and police chiefs have vowed to uphold and defend the Constitution against Obama’s unconstitutional gun control measures.  We applaud these public servants for their courage and conviction.  

The remarkable thing about what these brave men and women are doing is that nobody told them to do it.  Neither the CSPOA nor any other organization that we are aware of contacted sheriffs across the nation and asked them to make statements; this is something sheriffs did on their own, or because their constituents requested it of them.  Soon, people started submitting letters and links to us, and it was such a remarkable thing that we started to collect all the names and list them together.  Then the miracle happened: Other sheriffs across the nation have been inspired by the courage of those who stood first.  Now we see the power of standing, even if you fear you may stand alone.

NOW, powered by the gaining momentum of this movement, the CSPOA has joined with other like-minded organizations in a largely volunteer effort to contact all the remaining sheriffs and ask them for a statement. You can read more about this effort here.

Disclaimer: While we encourage all sheriffs and peace officers to join CSPOA, the list below includes members of the CSPOA and any others who have gone on record to uphold their oath by having made public statements, written open letters or contacted us personally and asked to be included. We have indicated which sheriffs are members of the CSPOA.We evaluate each sheriff on a case by case basis, but in general we are looking for sheriffs whose statements contain:

How NOT To Get On The List

We used to have a list down here of lame sheriffs who are declining to defend the rights of their people, seemingly not realizing what is at stake or trusting the feds to be the only source of truth. Richard Mack has started calling this our Red Coat List. This list has now grown to include not just sheriffs and associations with cowardly stances, but also those who are openly attacking the good men and women who are standing firm. And here we thought everybody already knew that the government asking you to report your neighbors for differing political views was a bad idea. No, turns out this Nazi sheriff in Florida just got the House and Senate budget leaders to award him ONE MILLION DOLLARS to be used for that very purpose. Did we learn nothing from Hitler?

Here’s the way it will work: If you hear your neighbor say something angry or threatening about the government or anybody in it, you just report them. Then the nice men in their shiny white coats will knock on their door and ask if everything is OK.

CONNECTICUT GOVERNOR JOINS THE RED COAT LIST

“The legislation adds more than 100 firearms to the state’s assault weapons ban and creates what officials have called the nation’s first dangerous weapon offender registry as well as eligibility rules for buying ammunition. Some parts of the bill would take effect immediately after [Governor] Malloy’s signature, including background checks for all firearms sales.”

DEMOCRATS AND LIBERALS ATTEMPT TO SLAP DOWN SHERIFFS WHO SUPPORT THE CONSTITUTION

Several news items have hit recently regarding attempts by the government to bully the local sheriffs who are standing strong for the constitution and oppose gun control. Clearly the power seekers are afraid of something… most likely, the freedom of the masses.

And this jewel from Texas Representative Yvonne Davis (Democrat) who has introduced HB2167 into the Texas Legislature. This measure would remove from office any Sheriff or law enforcement officer who refuses to enforce (or directs his subordinates to refuse to enforce) State or Federal laws. In fact, it goes further and provides for the removal of any elected or appointed law enforcement officer for simply stating that he/she will not obey federal orders. You understand of course that if this passes, it makes the sheriff answerable to the government rather than the people, and it makes the sheriffs mere puppets of the feds.

SHERIFFS WHO JUST DON’T GET IT

This section is clear down at the bottom, where it belongs. It contains a few links to statements with a lot of truthiness that miss the whole point. Most of the statements from sheriffs below this line contain some statement about it being their job to enforce the law, not to pick and choose. A great response to this can be found in a letter from Cleveland County, Oklahoma Sheriff Joe Lester who stated, “I was trained in the US Army, under the authority of the Uniform Code of Military Justice, that I had the right and the duty as a member of the military to disregard any order that I knew to be unlawful.” Even soldiers in the military are not supposed to blindly follow orders. They are supposed to use their own moral compasses to determine right and wrong. Failure to do so rests on their own shoulders, and the same is true for every individual – not just in this country – but in the world.

Sheriff Gary Raney, Ada County, Idaho – I uphold all of the Constitution, not just part of it and an excellent rebuttal here.

And look! Here is a post a the sheriff’s site in Ohio, quoting the local sheriffs association on the issue. For those of you who understand the impending threats, this may make you slightly sick to your stomach. Who will stop the tyrants? Will the tyrants regulate themselves?

Michigan Sheriff’s Association takes the low road – WatchDog Wire reports that in response to questions from citizens on their Facebook page, the Michigan Sheriff’s Association took the bold, decisive step of deleting the posts after hiding behind the old “it’s not our job to make the laws; we just enforce ‘em” schtick. Way to be answerable to the public, guys. You are of the same mindset as the cops who threw Rosa Parks off the bus.

Somebody recently submitted the following “Add my sheriff” request to us:

“As Sheriff elected twice by the citizens of Snohomish County, I swore to support, defend and obey the Constitution AND laws of the United States of America. At this time, there have been no changes to federal or state gun laws. As a law enforcement agency, it is not our role to comment on or criticize policy recommendations – it is our job to uphold and defend the laws of our county, state and country. If new federal or state gun laws are passed, I will discuss the best way to follow the spirit of those laws with Snohomish county leadership, Washington state legislators, and my colleagues at other law enforcement agencies.”

Sorry, but this is the OPPOSITE of what we need. A statement so wimpy and ambiguous that it could mean anything. Is he for or against? Will he uphold the Constitution or the unconstitutional laws? Could be either… or both. Or neither.

We could list many more, but frankly we don’t want to. It’s just too stinkin’ depressing! Let’s get out there and let our elected leaders know that we expect a more valiant response.

“The Constitution protects us from our own best intentions…so that we may resist the temptation to concentrate power in one location as an expedient solution to the crisis of the day.”

The “crisis of the day?” Was Scalia clairvoyant? He rendered this opinion in June of 1997. Now we are dealing with the Obama administration and others (Rham Emanuel) whose mantra is “Never let a good crisis go to waste.”

Horrible examples of “crisis intervention” were seen during the aftermath of a bombing in Boston, a hurricane in New Orleans and a shooting in Connecticut. We see them whenever any other “emergency” arises. The police and Federal agents grant themselves power to suspend the Constitution, suspend American ideals and principles, and suspend their oaths of office to “make us all safer.” The police in Boston went door to door drawing down on numerous citizens inside their own homes! During the chaos after Katrina ravaged New Orleans the police went door to door confiscating guns from law abiding citizens. After the Sandy Hook shootings legislators in Washington, Colorado, New York and Connecticut all tripped over themselves to create schemes of gun control laws aimed again at law abiding citizens!

It’s during crises that the Constitution is really put to the test. It’s then that those who have sworn to protect and defend it are given a chance to show their true character and dedication to principles of American liberty. If all that is needed is a “crisis” or “emergency” to justify the destruction of our Constitution and the individual liberties of our citizens, then our enemies need only to create “crises” and “emergencies.” The result is a tremendous blow to freedom and the destruction of our Constitution, and thus the foundation of America. I pray that our nation’s sheriffs and police will stand and be counted regardless of the pressures and temptations to violate our oaths as an “expedient solution to the crisis of the day.” Crises will happen and emergencies will come and go, but precious liberty, once lost, will be next to impossible to regain.

Sheriff Richard Mack (Ret)

An 8th grade student wore an NRA T-shirt to school. An inoffensive shirt with a picture of a gun and a simple slogan: PROTECT YOUR RIGHT. Anyone with at least an 8th grade education and a basic understanding of the Constitution should call this shirt patriotic.

But it was just too much for some people. Like one of his teachers, who confronted him about his shirt and picked a fight that ended with him being sent to the office. Well that darned patriotic shirt was just too much for the people in the office as well. They demanded that he change it. Courageously, Jared Marcum of Logan Middle School in West Virginia stood his ground and refused. He did not become aggressive or violent, but he refused to change his shirt. His father–a military man and NRA supporter–had taught his son well.

Now let’s be clear here: The school dress code prohibits clothing that displays profanity, violence and discriminatory messages, but NOWHERE does it say anything about images of guns or any kind of weapons, for that matter. Jared was not being rebellious or disruptive. He was just a kid wearing a shirt.

Well, once Jared had stood up to the administration they of course had to make an issue of it. Can’t admit they were wrong or anything; NO, they have to CALL THE COPS. Sure enough, they had him arrested. Not just suspended from school; ARRESTED. Because now he was challenging the school’s authority and an example had to be made. At this point, clearly the fight stopped being about a shirt with a gun on it and started being about the arrogance of the school administration who could not admit when they were wrong.

Jared has been charged with obstruction and disturbing the education process. A kid with no prior offenses now has a record. Meanwhile the school administration continue to refuse to talk with the press or to give Jared or his parents any justification for their Nazi-like actions.

What needs to happen here? Somebody needs to stand up and step in. The school needs to issue an official apology, a teacher needs to issue an apology and all charges need to be dropped. If you live in the Logan County area, we encourage you to contact your school board and let your voice be heard.

Note: Logan County Sheriff Sonya Porter is on our Sheriffs Say No To Gun Control list, having submitted a statement to us directly. We attempted to reach her by phone for comment, but the office number just rang and rang. Maybe they’re a little overwhelmed by all the media attention.

There is always another group of people who seek to enslave and control others. They thrive in environments of chaos, murder and mayhem. Put them in the happiest, most peaceful circumstances imaginable and they will immediately begin seeking for ways to stir up trouble. They must gain advantage; they must gain power and control; they must destroy the peace. It is their nature.

These groups may vary in size and dominance, but neither of them will ever be a majority of the population. Thousands of years of recorded history has proven that most of the time, most of the people just don’t care that much either way. Most people will not rise up in rebellion against a corrupt government until they literally (and I mean that literally) have nothing left to lose. When they are starving to death and their families are either dead or on the brink of extinction they will fight, but until then, not so much. They may grumble about taxes being too high or the government controlling their lives too much, but as long as they’re getting by they won’t do anything about it. They just won’t. And when those people are living in freedom, they will enjoy it and never give a second thought to any possible threats. Want further proof? Look at the ridiculously low voter turnouts for any recent election. These people will tell you they love their freedom and their country, but what they really love is themselves.

We’ve heard all our lives about how “Our Fathers” fought for freedom, and how “all the people joined together” to create the marvelous US Constitution that protects our inalienable rights, but the truth of the matter is we barely survived that. In spite of the long list of grievances spelled out in the Declaration of Independence, most people didn’t do much to help in the Revolutionary War. If they had, it would have been an easy victory. We were rebelling against an oppressive government whose leadership, men and weaponry came from a tiny country several month’s journey away by ocean voyage! All they could get was what they could bring here by boat and yet here we were, well-established with as much land and resources as anybody could possibly want, and we found it difficult to swat this fly off our backs. George Washington and his ragtag band of barefoot soldiers with limited ammo managed to pull off a few key victories through divine providence while members of our own government intentionally sabotaged his efforts, clogging supply lines and failing in recruiting efforts. Even after all the abuses, about 20% of the people living in the colonies remained faithful to Britain during the war. (That’s 500,000 out of about 2.5 million) It truly is a miracle that this free nation was ever founded.

That relatively small group of visionaries believed in something they valued more than their own lives. They were the guardians of liberty. Most people will never have something they believe in that much.

So who are the guardians of liberty now? You may not know them when you see them. They most likely have normal jobs and go about doing normal things: working for a living, paying their bills, attending their kids’ school activities and hopefully going to church. But in spite of all the small tasks of everyday living, they are thinking about the big picture. They’re concerned about signs they see in their community or in the national news that things are not going well. They wonder if there is something more they should be doing to protect what is most important.

If you managed to find this web site and read this far into the article, there’s a pretty good chance that you’re one of them. So now what? Well first, don’t be discouraged if you have trouble getting the majority of the people to recognize the importance of the cause of liberty. Because THEY NEVER WILL until it’s too late. And you know what else? Most of the people will never recognize the sacrifices that you may make to serve and protect them. In fact, they may ridicule you for it. (Kinda sounds like raising kids, doesn’t it?)

So the question to ask yourself is, does it matter whether they appreciate it or not? Does it change who you are, or what you stand for, or the value of the cause?

In our country right now we have a growing plague of chaos, murder and mayhem. You may not be seeing it as much in real life as you do on the national news, but you know it’s there and you know it’s growing. Much of the horror we see is coming from a small but quickly growing number who have lost their faith and values and turned to lives of violence or self-absorbed pleasure seeking. As we said near the top, this is the kind of environment where the power seekers thrive.

Even if you can’t prove it, you may strongly suspect that much of the chaos, murder and mayhem taking place in our nation right now is being perpetrated by factions within our own government. But let’s not get into conspiracy theories, because in the end it doesn’t really matter. The power seekers are always there, looking for opportunities to strike like a snake watching a hawk’s nest full of eggs until the adult leaves. They will take advantage of any crisis that comes along and create additional crises as necessary.

Fear is the great tool of the power seekers. One classic technique is to scare people into begging for protection. It is incredible how much scare power they are able to get out of a single crisis. A “lone mentally ill gunman” shoots up a schoolroom or theater and – while no one can deny the tragedy of the situation – the nation goes crazy with grief and evil men spring from the shadows, pretending that they can somehow legislate mentally ill gunmen out of existence. Being impossible, that kind of protection requires infinite resources and – of course – a loss of freedom to the individual. But it will all be worth it for the security we will gain.

Or not. Because you, Guardian of Liberty, know well enough that more government control is not the answer. Corrupt governments have committed more murders, atrocities and abuses than all the lone gunmen, guys in dark alleys with knives and cave men with big rocks that have ever existed. And how do you know if your government is corrupt? That’s easy. Give it power. Want to see it become more corrupt? Give it more power. Because the power seekers will always seek out the seats of power! Duh! And when the wicked rule, the people mourn.

Now we see the genius that inspired the guardians of liberty at the drafting of the Constitution: Create a government, but don’t give it any more power than it has to have to perform the very minimum of tasks that a government is needed for. And THEN, balance that power by dividing the government into 3 independent branches. And THEN, check that power by creating states within the union that retain the rights to resist the Federal government if it should overreach its’ bounds. And THEN, put the people in charge of everything by having public elections. They did everything they possibly could to insure the government they were creating would stay under control, because they knew well enough that sooner or later (probably sooner!) the power seekers would be in place.

Ok, then, good enough… so maybe – JUST MAYBE – it is IDIOTIC to think that throwing infinite resources at impossible problems is a good idea. But if we’re not going to stop lone gunmen and unabombers and airplane highjackers and a plethora of other threats (both real and imagined) with more laws and more government control, how then? Well, how have we been stopping them for the last 200 years?

“Well,” you say, “people didn’t used to do stuff like that.”
“Why not?” I reply. “Did the government stop them?”
“No, I don’t think so,” you respond. “I guess people were just different back then.”
“How?” I ask.
“Well, people were nicer to each other; more trusting. Nobody locked their doors. People went to church. Families stayed together. ‘A man’s word was his bond,’ as they used to say; people were honest. They looked out for each other and cared about each other, but they also believed in working hard for what they had, and not taking a handout when you didn’t need one.”
“Oh,” I respond. “You mean they had values? Morals? Faith?”
“Yeah,” a twenty-something college student interjects. (I hadn’t realized anyone was listening to our conversation!) “But we can’t be like that any more. We had to get rid of our values because they were offending some people. I guess the constitution says this is supposed to be a land free of religion.”

“Oh really?” I say with a raised eyebrow. “Is that what they’re teaching you in school these days?”
